1. Acceptance of Terms
By downloading, installing, or using the Hayuna mobile application (the “App”) or joining our pre-launch waitlist, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App or our services.
2. Eligibility
You must be at least 13 years old to use Hayuna. Users aged 13–17 must have parental or guardian consent to use the App, as required by applicable law. By using the App, you represent that you meet these requirements.
3. Description of Service
Hayuna is a somatic emotion-tracking application that helps users map physical sensations to emotional states using on-device AI. The App offers neurotype-adaptive profiles, body-based tracking, wearable integrations, and personal analytics. During the pre-launch phase, we operate a waitlist that collects your email address solely to notify you about launch and early access.
4. Not Medical Advice
Hayuna is a self-awareness tool, not a medical device, diagnostic tool, or replacement for professional mental health care or therapy. The App's insights, emotion labels, and regulation suggestions are for informational and self-reflection purposes only. Always seek the advice of a qualified health provider with any questions you may have regarding a medical or mental health condition. If you are in crisis or believe you may harm yourself or others, contact emergency services or a crisis hotline immediately.
5. Your Data
All emotional and biometric data is processed and stored exclusively on your device. We cannot access it. Your use of the App is also governed by our Privacy Policy, which explains our data practices in detail. You are responsible for securing data you choose to export (e.g., PDF or CSV files).
6. Acceptable Use
You agree not to:
- Reverse engineer, decompile, or disassemble the App except as permitted by law
- Use the App for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to our systems or other users' data
- Copy, modify, distribute, sell, or lease any part of the App or its content
- Use automated means to access the waitlist or submit false or misleading information
7. Intellectual Property
The App, including its design, software, AI models, content, and trademarks, is owned by Hayuna and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. Data you create within the App (emotional logs, body maps) belongs to you.
8. Third-Party Services
The App integrates with third-party services such as Apple HealthKit, Google Fit Air, and the WHOOP Developer Platform. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.
9. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT EMOTION TRANSLATIONS WILL BE ACCURATE FOR EVERY INDIVIDUAL.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAYUNA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.
11. Termination
You may stop using the App at any time. Uninstalling the App permanently deletes all local data. We may suspend or terminate access to our services if you violate these Terms.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App and updating the “Last Updated” date. Continued use after changes take effect constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the jurisdiction in which Hayuna is established, without regard to conflict of law principles.
